Permitting Overview

The Building Inspector issues building permits for any construction which is structural in nature in the Town of Tusten.  Examples would be new homes, sheds over 144 square feet, garages, pole buildings, additions, alterations, decks, electrical, pools, screen porches, re-roofing,  generators, septic, wells, and solar, etc.  Always check with the building department to see if a permit is required before performing any work.  Licensed electricians are required in Sullivan County.  Forms for the Building Department are available in the office and on this page.

Construction without a necessary permit is a violation on your property.  Fees are based upon the type of permit. 

Upon receipt of a completed building application and supporting documents, a review will be conducted.  Once the application is approved, a building permit will be issued.  Inspections are required before, during and a final inspection by the Building Inspector in order for a Certificate of Occupancy or a Certificate of Compliance to be issued.  Some structures were built prior to the requirement and are handled case by case. 

Use of any structure without a Certificate of Occupancy constitutes a violation on your property.  If you try to sell your property, or re-finance, the bank or financial institution will require that you provide them with a copy of your Certificate of Occupancy.

After the permit application review, it may be required for you to go before the Planning Board to obtain a special use or before the Zoning Board for a variance.  If required, the building department will direct you.

The Planning Board meets on the 3rd Monday of every month at 7:30PM.  The Planning Board makes decisions on subdivision and special use permit applications.  The Zoning Board of Appeals meets on the 1st Monday of every month at 7:30PM.  The Zoning Board makes decisions on variance applications.
